OpenAI Urges US Government to Establish Fair Use Standards for AI Training Data

OpenAI is advocating for the U.S. government to codify the principle of ‘fair use’ within copyright law as it applies to the training of artificial intelligence models. This proposal was put forth as part of the Trump Administration’s ‘AI Action Plan,’ which aims to reshape American AI policy. OpenAI argues that a copyright strategy that allows AI models to learn from copyrighted material is essential for maintaining America’s leading position in AI innovation. The company emphasizes that the fair use doctrine has been a key factor in the growth of AI startups, investment attraction, and research breakthroughs in the United States.

This isn’t the first time OpenAI has voiced its support for more lenient regulations regarding AI training. The company, which trains its models on vast amounts of web data, often without explicit consent from data owners, has previously argued that limiting AI training to public domain content would be insufficient for developing AI systems that meet current societal needs. OpenAI made a similar argument last year in a submission to the U.K.’s House of Lords. However, these arguments are likely to face opposition from content owners who have already filed copyright infringement lawsuits against OpenAI. These content owners dispute OpenAI’s stance, leading to an ongoing debate about the balance between AI development and copyright protection.
