AIMX Urges Review of Article 30-B in Mexico’s 2026 Economic Package for Digital Oversight

The Internet Association of Mexico (AIMX) has raised concerns over the proposed Article 30-B in the 2026 Economic Package, which would amend the Federal Tax Code to grant the Mexican Tax Administration Service (SAT) real-time access to digital platforms’ databases. AIMX warns that this measure could infringe on constitutional rights, international treaties, and the digital ecosystem’s sustainability. The proposal includes holding intermediaries jointly liable, potentially leading to constant surveillance of businesses and users, legal uncertainties, and risks of data misuse. AIMX highlights several risks: constitutional violations of privacy under Article 16, breaches of data protection laws, stifled innovation due to exposed trade secrets, and disproportionate operational burdens. Consumers may face higher prices and reduced digital trust, while businesses could incur high compliance costs or exit the Mexican market. AIMX suggests replacing real-time monitoring with selective, court-ordered audits, preserving intermediary liability limits, and safeguarding personal data and trade secrets. They also propose forming a multi-stakeholder working group, including industry, government, civil society, and Congress, to develop balanced digital taxation solutions that align with both digital and physical operations, ensuring Mexico’s digital transformation and technological inclusion remain on track.
