Senator Proposes Office to Regulate AI in Kenya with Fines and Penalties

Nominated Senator Karen Nyamu has tabled a Bill aiming to create an Office of the Artificial Intelligence Commissioner in Kenya, reflecting the need for formal regulation as AI use grows across sectors like manufacturing, media, transport, and hospitality. According to the proposed Artificial Intelligence Bill, 2026, the Commissioner will be appointed by the President with Parliament’s approval and will have powers to inspect AI systems, summon individuals, and access data or records upon notice. The office will also set ethical guidelines, classify AI systems by risk level, and issue enforcement notices. Additionally, the Bill outlines the formation of an advisory committee with representatives from the ICT Ministry, the Data Protection Commission, the National Commission for Science, Technology and Innovation, county governments, private sector players, and civil society. Non-compliance with the new regulations could attract penalties of up to Sh5 million or a maximum of two years imprisonment, or both. This move comes as Kenya sees rapid adoption of AI technologies, raising concerns over ethical use, data privacy, and potential misuse without proper oversight. The Bill aims to balance innovation with responsible AI deployment.
